In brief

These terms are an agreement between you and the developer of FM Auditor, not with Apple.
FM Auditor is free to use today. Pro and Auditor AI are paid features that are coming. There is nothing to buy in the app yet, and during the beta we switch Pro on by hand for some testers.
Your reports are yours. You are responsible for what is in them, including having the right to photograph the sites and people you audit.
The app is a tool. You remain responsible for every finding, grade and sign-off. Auditor AI only suggests, it can be wrong, and it never edits your text.
A link you create with Copy link works for anyone who has it until it expires. You choose 7, 30 or 90 days. Links cannot be switched off early yet.
Use the app lawfully. Do not reverse engineer it, overload it or work around the Auditor AI cap.
We may change or withdraw features. Export your reports regularly with the zip export.
Our liability to you is limited as far as the law allows, but nothing in these terms takes away your legal rights as a consumer or limits our liability for death or personal injury caused by our negligence.
The governing law is set out at the end.

Who these terms are between

These terms are between you and [Placeholder: developer's legal name, trading name and company number if any], of [Placeholder: postal address]. We call ourselves "we" and "us". You are "you".

Apple is not a party to these terms. Apple has no obligations to you under them, except as set out in the Apple-specific terms below.

If you use FM Auditor for your employer, you confirm that you have authority to accept these terms on its behalf as well as your own, and "you" includes your employer where that makes sense.

Accepting these terms

By installing or using FM Auditor, you accept these terms and our Privacy policy. If you do not accept them, do not use the app.

You must be 18 or over to use FM Auditor. It is a professional tool for facilities management auditors and it is not aimed at children.

Your licence to use the app

We give you a personal, non-transferable, non-exclusive licence to use FM Auditor on Apple devices that you own or control, as the App Store's usage rules allow. You may not sell, rent, lend, sublicense or give the app to anyone else.

The app is licensed to you, not sold. We and our licensors keep all rights in it that these terms do not expressly grant.

Your account

You do not need an account to use FM Auditor. If you create one, you agree to:

give us accurate details and keep them up to date;
keep your sign-in method secure, and tell us straight away if you think someone else is using your account;
take responsibility for everything done through your account.

You can sign out at any time. Signing out does not delete your data. To delete your account, see the Privacy policy.

The service today

Free. Creating reports, photos, markup, checklists, pins, the route, Report check, PDF and Excel output, the zip export, sharing and sync are free today.
Pro and Auditor AI. These are paid features that are not yet on sale. There are no purchases available in the app. During the beta we may switch Pro on by hand for some testers at no charge. We can switch it off again at any time, and it does not entitle you to Pro once purchases open.
When purchases open. We will publish the price, the billing period and how to cancel before you can buy anything. Purchases will be made through Apple and governed by Apple's terms as well as these. Auditor AI has a cap. Each account can check up to 3,000 findings a day. We may change the cap.

Beta and TestFlight builds

If you use FM Auditor through TestFlight or any other beta channel:

the build is unfinished and may have bugs, lose data or stop working;
Apple's TestFlight terms also apply;
we may change, reset or end the beta at any time;
please do not rely on a beta build for a report you cannot afford to lose. Export your work with the zip export.

Your content and reports

Everything you put into FM Auditor, including reports, findings, remarks, photos, markup, signatures, checklists, readings, sites, areas and layouts, is your content. You own it.

You give us only the licence we need to run the service for you: to store your content on your phone and, if you sign in, on our server; to sync it between your devices; to turn it into PDF, Excel and zip files; to host files you create with Copy link; and, if you switch Auditor AI on, to send the text of your findings to our AI provider and return its suggestions. We do not claim any other rights in your content and we do not use it for advertising or to train AI models.

You are responsible for your content. In particular you confirm that:

you have the right to be on each site you audit and to photograph it, and that where photos show people, badges or vehicles, you have a lawful reason to capture them and to put them in a report;
the names you enter for assignees, verifiers, site representatives and anyone mentioned in remarks are entered with a lawful reason, and that you will tell those people where your organisation's rules require it;
your reports are accurate to the best of your knowledge, and that you will correct them if you learn they are wrong;
nothing you put in the app is unlawful, defamatory or infringes someone else's rights.

We do not review your content. If we are told it breaks the law or these terms, we may remove it or suspend your account.

Professional responsibility

FM Auditor is a tool for recording and presenting what you find. It is not a substitute for your professional judgement.

The app's outputs, scores, grades, checklists and Report check results are not professional, legal, engineering or safety advice.
Auditor AI gives suggestions about the text of your findings. It can be wrong, incomplete or out of date. It never changes your text. You decide whether to use any suggestion.
You remain responsible for every finding, grade, priority, deadline, closeout and sign-off in your reports, and for any decision anyone makes on the strength of them.
If a finding concerns an immediate risk to life or property, act on it directly. Do not wait for the app.

Location and the route

Location features are under your control. You choose whether to grant the location permission, whether Record route is on, and whether recording continues when the phone is locked.

The route stays on your phone and is never synced. But the standard layout prints a Route map page, with the route, pins, start and end times and distance, into your PDF and Excel files, and a Map column with a map link for each pinned finding. Both are on by default. If you do not want them in a file you share, switch them off in the layout before you create it. Once a file is shared, the recipient has whatever it contains.

Copy link uploads a PDF or Excel file to your private folder on our server and gives you a web link. You choose how long it works: 7, 30 or 90 days.

Anyone who has the link can download that file until it expires. There is no password. Treat the link like the file itself.
Today, links cannot be switched off early in the app. If you need one removed, email us and we will delete the file.
You are responsible for who you send a link to and for complying with any confidentiality duty you owe your client.

Acceptable use

You agree not to:

use the app for anything unlawful, or to store or share unlawful, abusive or infringing content;
copy, modify, decompile, reverse engineer or try to extract the source code of the app, except where the law gives you a right we cannot exclude;
interfere with the service, probe or test its security without our written permission, or place an abusive load on it, for example by automating requests;
share one account between several people, create accounts by automated means, or work around the Auditor AI cap or any other limit;
use the app to build a competing product, or scrape or bulk-extract data that is not yours;
misrepresent who you are or who prepared a report.

Availability and changes

We are a small team and the app is young. We may add, change or remove features, change the free and paid tiers, or stop offering the service, at any time. Where a change materially reduces something you have paid for, we will tell you in advance and you may cancel.

Sync, sign-in, Copy link and Auditor AI depend on third parties, including Supabase, Apple, Google, Microsoft and TypeSafe. We do not promise that they will always be available. Your reports on the phone keep working without them.

Please export your data regularly with the zip export. It contains your photos, signatures, PDF and Excel files, and a machine-readable copy of each report. Keep a copy somewhere safe. It is your backup.

Intellectual property

FM Auditor, its design, code, templates, layouts, text and graphics belong to us or our licensors and are protected by copyright and other laws. The names FM Auditor, Auditor AI and Report check are our marks. These terms do not give you any right to use them except to describe the app.

If you send us feedback or ideas, we may use them without any obligation to you.

Third-party services and terms

Parts of FM Auditor rely on other companies' services, each with its own terms and privacy policy:

Apple: the App Store, TestFlight, Sign in with Apple, Apple Maps and on-device speech recognition.
Google: Sign-in with Google and Google Maps links.
Microsoft: Sign-in with Microsoft.
Supabase: hosting for our database, storage and server code.
TypeSafe: the AI provider behind Auditor AI.

You must comply with those third parties' terms when you use their services through FM Auditor. We are not responsible for them.

Ending the agreement

You can stop using FM Auditor at any time by deleting the app. You can ask us to delete your account as described in the Privacy policy.

We may suspend or close your account, or stop you using the app, if you seriously or repeatedly break these terms, if we must do so by law, or if we withdraw the service. Where we reasonably can, we will warn you first and give you a chance to export your data.

When the agreement ends, your licence to use the app ends. Sections that by their nature should continue, including those on your content, intellectual property, warranty, liability and governing law, continue to apply.

Warranty disclaimer

We provide FM Auditor as it is and as available. We will take reasonable care and skill in providing it, but we do not promise that it will be error-free, uninterrupted, secure or fit for any particular purpose, that it will meet any regulatory or contractual standard you work to, or that Auditor AI will be accurate.

If you use FM Auditor as a consumer, you have legal rights, including that digital content must be of satisfactory quality, fit for purpose and as described. Nothing in these terms affects those rights.

Limitation of liability

Nothing in these terms limits or excludes our liability for:

death or personal injury caused by our negligence;
fraud or fraudulent misrepresentation;
anything else that the law does not let us limit or exclude, including your rights as a consumer under the Consumer Rights Act 2015 if you are in the UK, or under the consumer protection laws of the UAE if you are there.

Subject to that:

we are not liable for any loss that was not a foreseeable result of our breaking these terms or failing to use reasonable care and skill;
if you use FM Auditor for business, we are not liable for loss of profit, loss of business, loss of contracts, loss of goodwill, business interruption, or indirect or consequential loss;
we are not liable for loss of or damage to your data where it could have been avoided by keeping a backup with the zip export, or for losses caused by a third-party service we do not control;
we are not liable for decisions you or anyone else makes in reliance on a report, a grade, a Report check result or an Auditor AI suggestion;
our total liability to you for everything arising from the app or these terms is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim and [Placeholder: a fixed cap for free use, £100 suggested; owner to confirm with insurer or adviser].

If you use FM Auditor as a consumer, the limits above apply only so far as the law allows.

Apple-specific terms

Because you download FM Auditor from Apple's App Store, Apple requires these terms:

Acknowledgement. These terms are between you and us only, not Apple. We, not Apple, are responsible for the app and its content. These terms may not give you fewer rights than Apple's standard end-user licence terms.
Scope of licence. Your licence is limited to a non-transferable licence to use the app on any Apple-branded product that you own or control, as permitted by the usage rules in Apple's Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where available.
Maintenance and support. We alone are responsible for providing any maintenance and support for the app. Apple has no obligation to provide any maintenance or support for it.
Warranty. We alone are responsible for any product warranties, whether express or implied by law, to the extent not disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price you paid for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever for the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility alone.
Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
Intellectual property claims. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
Legal compliance. You confirm that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a "terrorist supporting" country, and that you are not on any United States Government list of prohibited or restricted parties.
Developer contact. Our name, address and contact details for questions, complaints or claims about the app are in the Contact section below.
Third-party terms. You must comply with any applicable third-party terms when using the app, for example the terms of your mobile network or of the sign-in and map services above.
Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. When you accept these terms, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.

Governing law and courts

These terms are governed by the law of [Placeholder: England and Wales suggested; owner to confirm], and the courts of [Placeholder: England and Wales suggested; owner to confirm] have jurisdiction over any dispute. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts.

Changes to these terms

We may change these terms from time to time. When we do, we will change the date at the top and summarise the change. If a change materially affects your rights, we will tell you in the app or by email before it takes effect. If you keep using FM Auditor after the change takes effect, you accept the new terms. If you do not accept them, stop using the app and ask us to delete your account.
